Terms of Service

Operator: Splashmax Creative Ltd.

Last updated: 22 September 2026.

These terms govern use of StreetCreator by buyers, creators, business users and visitors.

1. Acceptance of these terms

These Terms of Service govern access to and use of StreetCreator, including its website, marketplace, accounts, booking tools, payment-related features, messaging, delivery workflows, reviews, creator verification and related services.

By creating an account, browsing or booking through the marketplace, offering services, submitting a brief, making or receiving a payment, or otherwise using StreetCreator, you agree to these terms and any additional policies or booking-specific terms that apply.

Where account creation uses an explicit acceptance control, StreetCreator may keep an electronic record of the terms and privacy-policy versions accepted and the acceptance time.

2. Who operates StreetCreator

StreetCreator is operated by Splashmax Creative Ltd. References to “StreetCreator”, “we”, “us” or “our” refer to the platform operator unless the context requires otherwise.

StreetCreator provides marketplace technology and operational tools that help buyers and independent creators discover each other, define work, record bookings, process supported payments, submit delivery, review work and maintain transaction records.

3. Marketplace relationship

Creators generally act as independent service providers. StreetCreator is not their employer, agent or partner merely because they use the platform.

Unless StreetCreator expressly agrees in writing to provide a managed project or other direct service, the buyer and creator remain responsible for the commercial agreement covering the creative work itself, including scope, deliverables, dates, revisions and usage rights.

4. Accounts and eligibility

Users must provide accurate and current information when creating and maintaining an account. You are responsible for safeguarding your login credentials and for activity conducted through your account.

StreetCreator may require additional information, identity verification, business verification, payout details or other checks before certain features are made available.

5. Creator profiles and services

Creators are responsible for ensuring that profile descriptions, portfolios, rates, service packages, locations, equipment, availability and other representations are accurate and do not infringe third-party rights.

Verification is a trust signal and not a guarantee of future performance. StreetCreator may suspend, restrict or remove profiles where information is false, misleading, incomplete or raises legitimate trust or safety concerns.

6. Buyer responsibilities and briefs

Buyers should provide complete and accurate project information, including the expected service, location, date, budget, deliverables, deadline, references, brand requirements and usage expectations where relevant.

Buyers must have authority to commission the requested work and must not request unlawful, infringing, deceptive, abusive or unsafe content.

7. Bookings and scope

A booking should make the agreed service, price, creator, buyer, expected deliverables and relevant timing sufficiently clear. Material changes to scope, location, deadlines, deliverables or revisions may require a revised price, new booking or additional agreement.

8. Payments

StreetCreator may support payment methods provided by third parties, including mobile-money and card-payment providers. Payments are subject to provider availability, verification, limits, fraud controls and provider terms.

A booking is not treated as funded merely because a buyer attempted payment. StreetCreator may require provider-confirmed payment status before a booking becomes paid or active.

StreetCreator does not store full card credentials where those credentials are collected and processed by an external payment provider.

References to payment protection describe the platform workflow around verified payment, booking records, delivery approval and dispute support. They do not mean that StreetCreator provides regulated escrow unless a specific legally supported escrow arrangement is expressly identified.

9. Fees and commissions

StreetCreator may charge buyer service fees, creator commissions, managed-project fees or other charges that are displayed or agreed before the relevant transaction. Taxes, statutory charges, bank charges and payment-provider fees may apply separately where required.

10. Delivery, review and approval

Creators must deliver work in accordance with the agreed booking. Buyers should review submitted work within a reasonable period, request only revisions included in the agreed scope, and approve delivery when the agreed work has been satisfactorily completed.

StreetCreator may rely on booking records, messages, delivery submissions, timestamps and other available evidence when determining booking state or reviewing a dispute.

11. Creator earnings and settlements

Creator earnings become eligible for settlement only after the associated buyer payment has been verified and the booking has reached the required completion state.

Settlement timing may depend on payment-provider processing, creator verification, payout information, dispute status, fraud checks, operational review and applicable law.

12. Cancellations, refunds and chargebacks

Cancellation and refund outcomes may depend on booking stage, work already performed, non-refundable external costs, the original scope and available evidence. Buyers must not misuse chargebacks to avoid paying for properly delivered work.

13. Disputes

Buyers and creators should first try to resolve routine misunderstandings through clear communication. Where a material dispute remains, eligible users may use StreetCreator's dispute process where available.

StreetCreator may review booking records, messages, delivery evidence, payment status, revisions, deadlines and other relevant information before taking platform action.

14. Intellectual property and usage rights

Creators retain ownership of their pre-existing materials, tools, methods, templates and intellectual property unless expressly agreed otherwise. Ownership and usage rights in commissioned deliverables depend on the package, brief, licence terms and written agreement between buyer and creator.

15. Reviews and integrity

Reviews should reflect genuine booking experiences. Users may not buy, sell, fabricate, manipulate or coerce reviews or ratings. StreetCreator may remove reviews that are fraudulent, abusive, irrelevant, extortionate or unlawful.

16. Prohibited conduct

Users must not use StreetCreator for fraud, money laundering, payment manipulation, harassment, threats, discrimination, impersonation, malware, unlawful surveillance, exploitation, trafficking, illegal goods or services, or other unlawful activity.

Users must not circumvent platform fees or security controls through deceptive conduct, manipulate transaction records, interfere with the service or attempt unauthorised access to accounts or systems.

17. Safety and offline work

Some creative services require users to meet in person or work at physical locations. Buyers and creators are responsible for reasonable judgement about personal safety, permissions, travel, access, equipment, location rules and local laws.

18. Third-party services

StreetCreator may depend on external services for hosting, authentication, communications, analytics, payments, payouts, maps, storage or other functionality. Third-party services are governed by their own terms and may experience outages or restrictions beyond StreetCreator's control.

19. Suspension and termination

StreetCreator may restrict, suspend or terminate access where reasonably necessary to protect users, comply with law, investigate suspected abuse, enforce these terms, respond to security risk or protect marketplace integrity.

20. Service availability and changes

StreetCreator may add, remove, modify or temporarily suspend features, payment methods, supported markets or workflows as the product evolves. Continuous or error-free availability is not guaranteed.

21. Disclaimers and liability

To the maximum extent permitted by applicable law, StreetCreator is provided on an “as available” basis. Nothing in these terms excludes liability or consumer rights that cannot legally be excluded.

22. Governing law

These terms are governed by the laws of the Republic of Kenya, without limiting rights or remedies that cannot lawfully be excluded.

23. Changes to these terms

StreetCreator may update these terms to reflect product, legal, operational or regulatory changes. Material updates may be communicated through the platform or other appropriate channels.
